The Beginning of AI Regulation in the EU
Today, the EU ratified the EU AI Act. The EU AIA isn’t just another regulatory hurdle—it signals a tectonic shift in how businesses think about and deploy artificial intelligence. Much like the General Data Protection Regulation (GDPR), where companies were challenged to rethink their data privacy practices, the AI Act will shape how businesses develop and use AI.
This new law might feel daunting for tech companies, but it also presents an opportunity. Businesses that move quickly to align with the regulation can turn compliance into a competitive edge, using ethical AI practices as a selling point to customers and investors. Incorporating robust data and AI governance not only meets regulatory compliance but also contributes to the sustainability and longevity of a business. Having policies that protect against privacy and security risks is standard practice for crisis management and will serve as a sign of customer trust. Alternatively, those who don’t invest in AI governance may scramble to retrofit their systems—at significant cost—to avoid fines or bans.
The Four AI Risk Categories of the EU AIA
The Act categorizes AI systems based on their risks to human rights, privacy, and security. The four risk categories are unacceptable risk, high risk, limited risk, and minimal risk.
- Unacceptable Risk: AI systems that pose a clear threat to people’s safety, livelihoods, and rights. AI systems that are deemed to have unacceptable risks are strictly prohibited under the EU AIA. Examples:
- Social Scoring: Systems that evaluate or classify individuals based on their social behavior or characteristics. This spells trouble in discriminatory treatment.
- Subliminal Messaging: AI that manipulates human behavior without their awareness to cause harm.
- Exploiting Vulnerable Communities: Systems targeting vulnerable groups like children or disabled individuals.
- High Risk: AI systems that significantly impact individuals or society and can affect fundamental rights or safety. These systems will be subjected to strict auditing and review before commercial use. Companies must provide technical documentation, data governance practices, user disclaimers, model accuracy and robustness, etc. Examples:
- Critical Infrastructure: AI managing traffic flow or electricity grids.
- Education and Vocational Training: Systems determining access to education or evaluating students (e.g., grading software).
- Employment and Worker Management: AI in recruitment processes, employee monitoring, or task allocation.
- Law Enforcement: Predictive policing tools or evidence analysis.
- Administration of Justice: AI assisting judicial decisions.
- Limited Risk: AI systems with a lower risk but still require some level of regulation to ensure transparency. Companies building limited-risk AI systems must inform their users that AI is being used. Example:
- Chatbots and Virtual Assistants: AI systems that communicate and manage personal information.
- Emotion Recognition Systems: AI that detects emotions or intentions.
- Deepfakes: Synthetic media where users must be alerted that content is artificially generated or manipulated.
- Minimal or No Risk: AI systems that pose minimal or negligible risk to rights or safety. These systems are largely unregulated under the Act and can be developed and used freely, adhering to existing laws. Examples:
- Spam Filters: Email services filtering unwanted messages.
- Customer Service Routing: Basic AI directing calls to appropriate service departments.
- Photo Editing Software: AI features in apps that enhance images.
It’s important to note that the classification of AI system risk is context-dependent. An AI system’s risk level may change based on its application context. For example, facial recognition could be a minimal risk in a personal photo app but a high risk in surveillance. While innovators often consider regulation to be a stop sign, I believe it is the responsibility of regulatory bodies to set rules and standards that protect the people and the planet. The EU AI Act safeguards fundamental rights by helping businesses mitigate risks and seize opportunities presented by responsible AI deployment.
Impact on Businesses
For years, companies have used AI to automate tasks, increase efficiency, and offer new services. New AI regulations like the EU AIA now ask companies to prioritize governance as much as innovation. Businesses should not be adopting a “move fast, break things, then fix later” approach. Neglecting the negative impacts and plausible risks of AI features can result in significant penalties.
Businesses must continuously assess their AI systems and comply with regulatory guidelines applicable to the risk category in which their AI products or services fall. Companies must make informed product decisions when investing in AI technologies. For non-EU companies, compliance with the EU AIA must be ensured when entering the EU market. Critical high-risk industries like finance, insurance, healthcare, and education must assess their AI systems. For instance, a fintech company offering credit assessments via AI will be classified as high-risk, meaning they’ll need to ensure their models are transparent, explainable, and unbiased. The entire lifecycle of an AI system—from training data to deployment—will require explainable/transparent documentation for audit. This will likely be a challenge for companies using “black-box” models.

AI will continue to be a tool we strive to improve and integrate into our lives. Regulation ensures that our risks and fears about the technology will be kept at bay. To do so, businesses must comply with regulations and uphold a high standard of doing good. Proactively auditing AI systems, building transparency, investing in ethical AI research, and creating dedicated compliance teams will be vital for navigating space. Companies that take these steps early will align with the law and position themselves as leaders in responsible AI innovation. By embedding these practices into their development processes, businesses can ensure long-term success in a world where ethical AI governance is becoming a competitive advantage.
